Namibian road traffic law defines a “driver” as anyone who drives or attempts to drive a vehicle. This includes a person riding or attempting to ride a pedal cycle, and a person driving or guiding animals pulling an animal-drawn vehicle. 3
The Road Traffic and Transport Act 22 of 1999 provides the framework for road safety and traffic use, while the Road Traffic and Transport Regulations, 2001 set detailed driving rules. Drivers must keep a reasonable and prudent following distance, remain in complete control of the vehicle, have a full view of the road and traffic ahead, and must not allow interference with the steering or operating mechanisms. 4
A driver must secure an unattended vehicle so that it cannot move. A driver leaving a parked or stationary position may proceed only when doing so will not interfere with approaching traffic or endanger people or other traffic. Drivers must also give immediate and absolute right of way to specified emergency vehicles sounding their authorised warning devices. 4
An authorised officer may temporarily stop a person from driving if that person appears physically or mentally incapable of driving safely. The officer may control traffic, direct a driver who impedes normal traffic flow to remove the vehicle or use another route, require identification from a suspected offender or witness, and demand prescribed vehicle documents. 5
Driving licences are divided into coded categories that authorise the holder to drive specified classes of motor vehicles. For example, code A1 covers certain motorcycles with an engine capacity not exceeding 125 cubic centimetres, subject to the stated exclusions. 6
